Substitute Water Supply Plans & Augmentation Plans

We have developed and maintain over 60 individual substitute water supply plans (SWSP) for various clients in Water Divisions 1, 2, 3, 5 and 7. The plans include gravel pit substitute water supply plans and Arkansas Basin Rule 14B plans for our sand and gravel mining clients as well as substitute water supply plans for the water rights our municipal clients. Many of these temporary plans are used over the short-term as the client concurrently develops a permanent plan for augmentation and completes the Water Court process.

Specific Project Experience

Aggregate Industries, Inc.

Aggregate Industries has retained Applegate Group, Inc. to maintain compliance for the substitute water supply plans and well permits at their various mining sites along the Front Range including the South Platte, Cache la Poudre, and St. Vrain Creek basins. We developed a water resource accounting procedure to track and report operational water use and subsequent replacement or augmentation. Water Court application engineering assistance is also provided for sites requiring long-term plans of augmentation.  Our services also include groundwater modeling to determine the effect of mining operations on surrounding water rights.

Clear Creek County

Clear Creek County developed a Water Bank to provide augmentation water for the communities in the upper Clear Creek basin. We provide the general water rights assistance to the County, and have also provided the engineering support for the development of a basin wide plan for augmentation for the County. The basin wide plan for augmentation is pending in Water Court.

Connell Resources, Inc.

We currently maintain the substitute water supply plans and well permits on four of the sand and gravel mining sites used by Connell Resources, Inc. for road construction materials. We developed a recharge program using Connell’s Box Elder Ditch water rights to provide augmentation water for the mining operations. The measuring devices and recharge program were inspected by the Water Commissioner and approved by the State Engineer’s Office. We also completed the first substitute water supply plan in Division 6 for a new mining site.

Lafarge West, Inc.

We maintained the substitute water supply plans and well permits on a large number of Lafarge’s sand and gravel mining sites in the Poudre, South Platte, St. Vrain, Arkansas, Colorado, and Yampa River Basins. Evaluations were completed to determine the total water demand associated with the mining sites and also for the water rights owned by Lafarge to determine historical consumptive use available for augmentation. We also assisted Lafarge with long-term planning for the future augmentation requirement for the sites in each basin. After reclamation of certain sites with unlined lakes, we provided engineering support for the long-term plans of augmentation for evaporative losses. Our services also included groundwater supply modeling to determine the effect of mining operations on surrounding water rights.

Ready Mixed Concrete Company

We assisted Ready Mixed Concrete Company (RMCC) in evaluating the existing water rights on a potential property for a gravel pit and have since taken this site through the well permitting and substitute water supply plan process. This has included determination of water demands, evaluation of augmentation alternatives and a completion of a historical consumptive use evaluation of Brighton Ditch rights used on the property. Additionally, we have evaluated the current lease market of water supplies in the South Platte Basin.
