Historically, the SEO has left the oversight of Coalbed Methane Gas wells up to the Colorado Oil and Gas Conservation Commission. However, the recent Supreme Court decision in Vance v. Wolf requires that produced water is subject to administration and well permitting from the SEO. This decision requires that over 5,000 wells in Colorado obtain water well permits by April 1, 2010. The current rulemaking process will decide the process that engineers and geologists will use to determine if the groundwater produced through this process is tributary or non‐tributary, and subject to augmentation.
